Welcome to Nanang Mahdaen El Agung's personal website. These Terms of Service ("Terms") govern your access to and use of https://www.mahdaen.name (the "Service"). I offer professional software engineering, web development, and open-source contributions. My services include, but are not limited to:

  • Software Engineering: Custom desktop application development using web technologies, system optimization, and legacy system modernization.
  • Web Development: Custom website development, e-commerce solutions, website redesign, and maintenance.
  • Open Source Contributions: Building and maintaining various open-source projects, and contributing to the broader open-source community.

Specific details regarding project scope, deliverables, timelines, and compensation will be outlined in a separate, mutually agreed-upon project agreement or contract for each engagement.

2. User Obligations

By using the Service, you agree to:

  • Provide accurate and complete information when contacting me or requesting services.
  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Not engage in any activity that interferes with or disrupts the Service, or the servers and networks connected to the Service.
  • Not attempt to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service.

3. Intellectual Property

  • Your Content: You retain all rights to any content or data you provide to me for the purpose of a project. You grant me a limited, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing the agreed-upon services.
  • My Work Product: Unless otherwise explicitly agreed upon in a separate project agreement, the intellectual property rights for the custom software, websites, or other deliverables created by me for you will be transferred to you upon full payment for the services.
  • Open Source Projects: All open-source projects I build or contribute to are governed by their respective open-source licenses (e.g., MIT, Apache, GPL). Your use of these projects is subject to the terms of those licenses.
  • Service Content: All content on this website, including text, graphics, logos, images, and the compilation thereof, is my property or the property of my licensors and protected by copyright and other intellectual property laws.

4. Limitation of Liability

In no event shall Nanang Mahdaen El Agung, nor my suppliers or licensors, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not I have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

5. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

I do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

7. Changes to Terms

I reserve the right, at my sole discretion, to modify or replace these Terms at any time. If a revision is material, I will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at my sole discretion.

By continuing to access or use my Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
